A. Registration

While we may require you to provide additional information as necessary to verify the accuracy of your identity and the information you provide to us, you understand and agree that we do not sponsor or endorse any user.

C. No Account Sharing

You will not use, attempt to access, or ask for the login credentials for any third party’s account at any time. You will not allow any third party to access or use your account at any time, nor provide any third party with your login credentials. We will not be liable for any loss that you may incur as a result of any third party that uses your password or otherwise accesses your account, either with or without your knowledge. You will be liable for losses incurred by us or any third party due to release of account credentials to unauthorized persons.

D. Termination by You

You may delete your account by clicking “Delete Account” in your account settings. You will not assign, transfer, sell, or share your membership to Goldendragon.casino. If you do, both you and any unauthorized user are jointly and severally liable for any fees that will be
due.

E. Termination by Us

We may suspend or terminate your account, membership, and any licenses herein, at any time, for any reason, in our sole discretion, including if you violate these Terms and Conditions or if your account becomes inactive for more than six months. If we terminate your account, you will be responsible for all charges to your account at the time of termination, and any remaining balance in your accounts will become non-refundable. 2. Grant of Rights

Subject to the limited rights expressly granted herein, ARATECH LLCreserves all rights, title, and interests in and to the Platform and Materials, including all related intellectual property rights. No rights are granted to you hereunder other than as expressly set forth herein.

B. Trademarks

Unless otherwise noted, all Materials, including logos, brand names, and taglines, are the service marks, trademarks, and/or trade dress of ARATECH LLC. Such marks may not be copied, imitated, or used, in whole or in part, without the prior written permission of ARATECH LLC. All other trademarks, company names, or logos are the property of their respective owners. The display or use of our trademarks or third-party trademarks on the Platform does not grant or transfer any license or ownership.

C. Copyright

All content included on the Platform, including the Materials, is the copyright of ARATECH LLC or its licensors and is protected by U.S. and international copyright laws. All rights reserved. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, perform, display, or in any way exploit, any of the Materials in whole or in part.

D. Patents

One or more patents may apply to the Platform and the features and services accessible via the Platform, including, without limitation, U.S. Patent Nos. $$insert patent numbers.

5. Arbitration Agreement & Waiver of Class Action

PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND ARATECH LLC TO ARBITRATE DISPUTES AND IT LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM ARATECH LLC.

A. Applicability of Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Florida before one arbitrator.

B. Arbitration Procedures

Arbitration shall be conducted in English in accordance with the rules then prevailing of the American Arbitration Association (“AAA”). The arbitrator shall be selected in accordance with AAA rules. The arbitrator shall apply the laws of the State of Florida consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. The arbitrator shall be authorized to award individual relief, including, without limitation, compensatory, punitive, and equitable relief. The award of the arbitrator shall be final and binding on you and ARATECH LLC.

C. Location of Arbitration

The arbitration shall take place in Florida, unless you and ARATECH LLC agree otherwise.

D. Payment of Arbitration

Fees Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules, unless otherwise stated in this Agreement to Arbitrate. If the value of the relief sought is $10,000 or less, ARATECH LLC will reimburse you for all filing, administration, and arbitrator fees, unless the arbitrator finds your claim to be frivolous. If the value of the relief sought is more than $10,000, the AAA rules will govern payment of these fees.

E. Waiver of Class Action

YOU AND ARATECH LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and ARATECH LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

F. Exception – Small Claims Court Claims

Notwithstanding the parties’ agreement to resolve all disputes through arbitration, either party may seek relief in a small claims court for disputes or claims within the scope of that court’s jurisdiction.

ARATECH LLC DOES NOT WARRANT THAT THE PLATFORM OR THE FUNCTIONS, FEATURES, OR CONTENT CONTAINED THEREIN WILL BE UNINTERRUPTED OR ERROR FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

ARATECH LLC SHALL NOT BE LIABLE FOR THE USE OF THE PLATFORM, INCLUDING, WITHOUT LIMITATION, THE CONTENT AND ANY ERRORS CONTAINED THEREIN.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARATECH LLC, NOR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS, BE LIABLE TO ANY PERSON FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, REVENUE, GOODWILL, USE, OR DATA), HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, WARRANTY, NEGLIGENCE, OR OTHERWISE, EVEN IF ARATECH LLCHAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ARATECH LLC’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS AND CONDITIONS OR THE PLATFORM, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE GREATER OF (I) THE AMOUNT PAID, IF ANY, BY YOU TO ARATECH LLCFOR ACCESS TO OR USE OF THE PLATFORM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (II) ONE HUNDRED DOLLARS ($100).

8. Indemnification

You agree to indemnify, defend, and hold harmless ARATECH LLCand its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from (i) your violation or breach of these Terms and Conditions; (ii) your use of the Platform; or (iii) your violation of any law or the rights of any third party.

9. International

We control and operate the Platform from our offices in the State of Florida in the United States of America. We do not represent that Materials on the Platform are appropriate or available for use in other locations. Persons who choose to access the Platform from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. You agree to comply with all applicable laws, rules, and regulations in connection with your use of the Platform.
